By using this website (including browsing, creating an account, placing an order, or contacting support), you agree to these Terms.

If you do not agree, you must stop using the website.

2. Age restriction

This website and products are intended for individuals aged 18 years or older.

By using this website, you confirm you are 18+.

We may cancel an order, refuse service, or restrict access if we reasonably believe this requirement is not met.

3. Definitions

In these Terms:

Website means this online store and any pages, content, tools, checkout, and services offered through it.

Products means goods sold on this Website.

You means the person using the Website or placing an order.

Order means a purchase request submitted through checkout.

Consumer Law includes the Australian Consumer Law and any mandatory consumer protection laws that apply to you.


PART I – WEBSITE USE

4. Website content & intellectual property

Unless otherwise stated, all content on the Website (including text, product listings, images, branding, software and design) is owned by or licensed to Lollipop Technology and is protected under Australian and international intellectual property laws.

You may not, without our prior written permission:

  • reproduce, distribute, publish, or commercially exploit Website content

  • scrape, harvest, data-mine, or systematically copy content

  • use our branding, trade marks, or product images for commercial purposes

We reserve all rights not expressly granted.

5. Accuracy and availability of information

We aim to keep information accurate and current. However:

  • product packaging may change

  • images may vary by screen/device

  • some information may become outdated

To the maximum extent permitted by law, we do not guarantee that content is error-free, complete, or current.

This clause does not exclude any rights you have under applicable Consumer Law.

6. Acceptable use and prohibited conduct

You must not:

  • use bots, scrapers, spiders, crawlers or automated tools to access the Website

  • attempt unauthorised access to any system, account, server, database or network

  • probe, scan, test, or exploit Website security or vulnerabilities

  • interfere with site operations, checkout flows, or other users

  • submit false, misleading, or fraudulent information

  • use the Website for unlawful conduct, harassment, or infringement of rights

We may suspend, restrict, or block access (including to accounts) where we reasonably believe misuse, fraud, abuse, or security risk exists.

PART II – ORDERS & PURCHASES

9. Orders and contract formation

When you place an Order:

  • you are making an offer to purchase

  • you will receive an order confirmation email (this is not acceptance)

A binding contract is formed only when we:

  • confirm dispatch, or

  • otherwise confirm acceptance in writing.

We may refuse, cancel, or limit an Order at any time prior to acceptance, including where:

  • a Product is unavailable

  • pricing or listing errors occur

  • we suspect fraud, misuse, or unauthorised activity

  • we cannot reasonably verify an Order

  • shipping restrictions apply

If we cancel an Order after payment is taken, we will refund the amount paid for the cancelled item(s) using the original payment method (subject to payment provider processing times).

10. Pricing, currency and errors

Prices are displayed in the currency you select (or the Website default currency).

We may change prices at any time.

If a Product is listed at an incorrect price due to error, we may cancel the Order and refund you.

11. Payment processing and chargeback risk

Payments are processed by independent payment providers.

We may take reasonable steps to verify Orders for fraud prevention, including requesting additional information.

If a chargeback is initiated, we may:

  • provide order, delivery and communication records (including tracking and address details) to banks/payment providers

  • suspend related accounts pending investigation

  • restrict future purchases where fraud or misuse is reasonably suspected

This does not limit your legal rights.

We also reserve the right to refuse service where we reasonably identify repeated refund abuse, false claims, or suspicious patterns of activity across orders (for example, repeated claims of non-delivery where carrier records show delivery).

12. Product use disclaimer and safety

Products sold on this Website are intended for private adult use.

To the maximum extent permitted by law:

  • Products are supplied “as is” unless a specific warranty is stated

  • you are responsible for safe, appropriate and lawful use

  • we make no medical or therapeutic claims unless explicitly stated

  • you must follow usage and care instructions

Improper use may cause injury or damage. You assume all risks arising from misuse, incorrect handling, or failure to follow instructions.

Nothing in this clause excludes consumer guarantees under applicable Consumer Law.

13. Warranties and consumer guarantees

Some Products may come with a stated warranty (including any warranty described on our dedicated warranty page).

Australian consumers may have non-excludable rights under the Australian Consumer Law, including guarantees that goods are of acceptable quality and match their description.

Where permitted by law, our liability for breach of a consumer guarantee may be limited to (at our option):

  • repair

  • replacement

  • resupply

  • refund

depending on the type of Product and the nature of the failure.

13.1 Our 2-Year Warranty Guarantee

Every product purchased directly from Lollipop Shop comes with an Industry Leading 2-Year Warranty Guarantee from the order purchase date.

This warranty covers manufacturing issues and functional defects (not misuse or wear and tear). If the product qualifies, we will replace it or offer a comparable item of equal value if the original is unavailable.

What’s covered (examples):

  • internal motor failure

  • button malfunctions

  • charging issues not caused by damage

  • dead-on-arrival (DOA) devices

  • structural failure that impacts function (not caused by misuse)

What’s not covered (examples):

  • cosmetic issues (scratches, marks, discoloration)

  • normal wear and tear

  • damage caused by dropping, smashing, bending, or biting

  • battery leakage or corrosion from improper storage

  • use of incompatible substances (including essential oils, coconut oil, baby oil, sunscreen, or edible products)

  • products tampered with or opened

  • products purchased from unauthorised third-party sellers

  • lost, stolen, or misplaced items

Important: any attempt to disassemble, repair, or modify the product will void the warranty.

What we need for a claim:

  • proof of purchase (receipt, order confirmation, or bank statement)

  • product name or SKU

  • a clear description of the issue

  • a photo or video showing the problem (where possible)

  • your full name and shipping address

How the warranty process works:

  • submit your claim through our support contact method with the above information (videos/photos can be shared via a cloud link)

  • we review within 3–5 business days

  • if approved, we issue an RWN number and return instructions (where inspection is required)

  • you cover return postage for inspection requests

  • once approved (and received, if required), we ship a replacement within 7–10 business days

  • we cover shipping of the replacement item to you

This warranty operates alongside and does not exclude rights you may have under applicable Consumer Law.

14. Limitation of liability

To the maximum extent permitted by law, we are not liable for:

  • indirect loss

  • consequential loss

  • loss of profit or revenue

  • loss of data

  • business interruption

  • reputational loss

arising from use of the Website or Products.

Where liability cannot be excluded, it is limited to the maximum extent permitted under applicable law.

15. Indemnity

You agree to indemnify and hold harmless Lollipop Technology and its directors, employees and agents from claims, losses, liabilities, costs and expenses (including legal fees) arising from:

  • your breach of these Terms

  • your misuse of the Website

  • your unlawful act or omission

  • your infringement of another party’s rights


PART III – SHIPPING

16. Processing times

Orders are generally processed within 1–3 business days (Monday to Friday, excluding public holidays).

Processing times are estimates and may vary during peak periods, promotions, or operational disruption.

17. Delivery times and delays

Estimated delivery timeframes are shown at checkout and may vary by destination.

As a guide:

  • UK & Europe: 7–15 business days

  • Australia & New Zealand: 5–12 business days

  • USA: 7–15 business days

  • Canada: 7–15 business days

Delivery estimates are not guarantees.

We are not responsible for delays outside our control, including:

  • customs processing

  • carrier delays

  • port congestion

  • extreme weather

  • service disruptions

Such delays do not automatically entitle you to a refund.

18. Discreet packaging

We ship in discreet packaging. External packaging does not display explicit product details.

Sender may appear as KLCN or GKWS to maintain discretion.

19. Address accuracy

You are responsible for providing a complete and correct delivery address.

If an Order is returned due to an incorrect or incomplete address provided by you, we may:

  • charge re-shipping costs, or

  • refund the order value minus shipping/handling where applicable.

19.1 Tracking and delivery confirmations

We will send you a tracking number upon dispatch.

Tracking may take up to 7 business days to appear or update.

Tracking often updates once the parcel has reached your destination country and has been scanned by the local delivery partner.

You are responsible for checking junk mail for order and tracking emails and ensuring our email address is permitted by your mail provider.

19.2 Partial shipments

We may ship orders in multiple parcels to get items to you faster. Separate tracking emails may be provided for each parcel.

19.3 Title and risk

Title to the Products transfers upon full payment.

Risk transfers when the carrier records the parcel as delivered to the address provided, or when the parcel is delivered to that address.

If tracking confirms delivery to the correct address, we are not responsible for theft or loss after delivery.

19.4 Lost parcels

If a parcel is lost in transit (for example, tracking shows no movement for an extended period), contact us and we will assist with an investigation.

If the carrier confirms the parcel is lost in transit, we may offer a replacement or store credit, depending on the circumstances and available evidence.


PART IV – RETURNS, EXCHANGES & HYGIENE

20. Return authorisation required

All returns require approval and a return authorisation process.

To request a return, contact customer support and provide:

  • your name

  • order number

  • item(s) requested for return

  • reason for return

Unauthorised returns may be refused and may incur handling/disposal fees where lawful.

21. Change of mind returns

Where change-of-mind returns are offered, the Product must:

  • be unused

  • be unopened

  • be in original packaging with seals intact

  • be in resalable condition

Return shipping is your responsibility unless required otherwise by applicable law.

Where store credit is offered for change-of-mind returns, it may be issued less any applicable disposal fees where lawful and clearly communicated.

22. Hygiene and intimate product exception

Due to hygiene and safety reasons, many Products cannot be returned once opened or unsealed, unless faulty.

This includes (without limitation): items intended for intimate contact, lubricants, consumables, and sealed hygiene-sensitive goods.

23. Faulty or damaged items

If your Product is defective or arrives damaged, contact us as soon as reasonably practical and provide:

  • order number

  • description of the issue

  • photos/video if requested

If a fault is confirmed, we will provide a remedy in accordance with applicable Consumer Law (which may include replacement, repair, store credit or refund depending on circumstances and legal requirements).


PART V – UK / EU / EEA TERMS

This section applies if you are a consumer located in the United Kingdom or the European Union/EEA.

24. UK Consumer Rights

If you are in the UK, you may have rights under the Consumer Rights Act 2015, including that goods must be:

  • as described

  • of satisfactory quality

  • fit for purpose

If goods are faulty, you may be entitled to a repair, replacement, price reduction, or refund depending on the circumstances.

25. EU/UK withdrawal rights and hygiene exception

If you are an EU/EEA or UK consumer purchasing online, you may have a legal right to cancel certain purchases within a “cooling-off” period.

However, that right may not apply to:

  • sealed goods that are not suitable for return due to health protection or hygiene reasons once unsealed, including intimate products.

Where the hygiene exception applies, any cancellation right ends once the seal is broken or the Product is opened.

This does not affect your rights where goods are faulty or not as described.


PART VI – UNITED STATES TERMS

This section applies if you are a consumer located in the United States.

26. No medical claims

Products are sold for adult novelty use. We do not make medical claims unless explicitly stated.

You are responsible for ensuring Products are lawful to import/use in your state or locality.

27. Disclaimers and limitation (US)

To the extent permitted by law:

  • the Website and Products are provided “as is” and “as available”

  • we disclaim implied warranties including merchantability and fitness for a particular purpose, except where prohibited by law

  • we are not liable for incidental, special, or consequential damages, except where prohibited by law

Some states do not allow certain limitations, so parts of this section may not apply to you.

Before starting formal proceedings, you agree to contact us first and allow a reasonable opportunity to resolve the issue.

To the extent allowed, you agree that disputes will be brought in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

For Australian customers, these Terms are governed by the laws of New South Wales, Australia, and applicable Commonwealth laws (including the Australian Consumer Law).

If you access the Website from outside Australia, you are responsible for complying with local laws and import restrictions.
